Appeals Court Should Be Impartial, Candidate Says

A candidate for the Texas Third Court of Appeals was in San Angelo on Monday, saying the court needs to be restored to the nonpartisan judicial body it was intended to be, allowing it to deal with its backlog of cases, some of which he said have been pending up to four years.
Austin appellate attorney Kurt Kuhn said the Third Court of Appeals, which covers Travis County and 23 others, including Tom Green County, is the most important appellate court in Texas because it hears appeals arising from cases that involve state agencies, the majority of which are in Austin.
Kuhn said he feels strongly qualified for the job because his practice with Brown McCarroll in Austin is made up of appellate cases. He is head of the firm’s appellate section, he said, and teaches appellate law at the University of Texas.
Third court decisions, he said, “affect every aspect of life in Texas, but people largely don’t know about it.”
His goal as an appellate judge, Kuhn said, would be to “apply the law fairly, act expeditiously and not be partisan.” Kuhn said he intends to campaign hard in every county of the Third District’s area. “Everyone should care about this court,” he said.
